These Terms of Service govern your use of silxine.com and purchases from Silxine. Silxine is operated by Winpac Advertising LLC. By using the site or placing an order, you agree to these Terms.
If you do not agree, do not use the site. Nothing in these Terms limits rights that cannot be waived under applicable law.
1. Eligibility and lawful use
You must be at least the age of majority where you live, or use the site with the involvement of a parent or legal guardian. You may use the site only for lawful personal or household purposes.
You may not interfere with the site, attempt unauthorized access, introduce malicious code, scrape or copy the site through automated means without permission, misuse another person’s information, or use the site to violate law or the rights of others.
2. Store platform
Our store is hosted by Shopify, which provides the commerce platform that allows us to sell products and services. Your use of Shopify-supported features may also be subject to Shopify’s terms and privacy practices.
3. Product information
We work to describe products, materials, measurements, care, and colors accurately. Screens display color differently, and natural materials can show small variations in texture, tone, or finish. These variations are not necessarily defects.
Product measurements are approximate and may vary slightly because garments are measured by hand. Follow the care label inside the garment; it is the final care instruction for that piece.
We may change or discontinue products, colors, sizes, prices, descriptions, or availability at any time.
4. Prices and payment
Prices are shown in U.S. dollars unless stated otherwise. Applicable shipping charges, taxes, discounts, and the order total are shown at checkout before payment.
You agree to provide current, complete, and accurate billing and account information. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment partners to charge the order total.
If a pricing or product-information error is discovered, we may contact you for instructions or cancel the affected item and issue a refund.
5. Orders and acceptance
An order confirmation acknowledges that we received your order; it does not guarantee acceptance or availability. We may limit or cancel orders where reasonably necessary, including for suspected fraud, resale, inventory error, payment failure, or violation of these Terms.
Your order is accepted when we send a shipping confirmation, unless applicable law requires otherwise. If we cancel an order after payment, we will refund the canceled amount to the original payment method.
6. Shipping and delivery
Available shipping methods, charges, and delivery estimates are shown at checkout before payment. After shipment, we provide tracking when it is available from the carrier.
Delivery dates are estimates unless we expressly state otherwise. Responsibility for the package remains with Silxine until delivery is recorded at the shipping address, subject to applicable law and any necessary carrier inquiry.
7. Returns, exchanges, and refunds
You may request an eligible return or exchange within 30 days after delivery. Returned items must be unworn, unwashed, free from marks or scent, and have their original tags attached. Items identified as Final Sale or non-returnable before purchase cannot be returned, except where required by law.
Current instructions, return-label fees, exchange terms, damaged-item procedures, and refund timing are provided on the site or by customer care and form part of these Terms. Nothing in those terms limits rights that cannot be waived under applicable law.
8. Accounts
You are responsible for keeping your account credentials confidential and for activity under your account. Contact us promptly if you believe the account has been used without permission.
We may suspend or close an account where reasonably necessary to protect customers, the store, or our legal rights. You may ask us to close your account by contacting hello@silxine.com, subject to records we must retain.
9. Promotions
Discount codes and promotions may have separate eligibility, timing, product, or use limits. Unless the promotion states otherwise, offers cannot be combined, are not redeemable for cash, and may be changed or ended before an order is placed. A discount does not apply retroactively to an earlier order.
10. Reviews and other submissions
If you submit a review, photo, comment, idea, or other content, you confirm that you have the right to share it and that it is accurate, lawful, and does not violate another person’s rights.
You grant Silxine a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, publish, and display the content for operating, improving, and promoting Silxine. This license lasts only as long as reasonably needed for those purposes, except for copies we must keep for legal or technical reasons.
We may remove content that violates these Terms. We are not required to publish every submission.
11. Intellectual property
The site and its text, images, design, graphics, logos, product names, and other content are owned by Silxine or used with permission and are protected by applicable intellectual-property laws.
You may view and use the site for personal shopping. No other license is granted. You may not reproduce, distribute, modify, sell, or commercially exploit site content without written permission.
12. Third-party services and links
The site may include tools, payment services, social features, or links provided by third parties. We do not control third-party sites and are not responsible for their content or practices. Your use of them may be governed by separate terms and policies.
13. Privacy
Our collection and use of personal information are described in our Privacy Policy. Available advertising opt-outs are provided through Your Privacy Choices, and additional privacy controls may be presented on the site where required.
14. Disclaimer
We work to keep the site accurate, available, and secure, but online services can be interrupted or contain errors. To the fullest extent permitted by law, the site is provided “as is” and “as available,” without warranties not expressly stated in these Terms.
We do not exclude any product warranty, consumer guarantee, or other right that cannot lawfully be excluded.
15. Limitation of liability
To the fullest extent permitted by law, Silxine and its officers, employees, agents, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the site or a purchase.
Where liability can lawfully be limited, our total liability for a claim relating to an order will not exceed the amount paid for the product giving rise to that claim. These limits do not apply to fraud, willful misconduct, personal injury caused by negligence, or any liability that cannot be limited by law.
16. Indemnity
To the extent permitted by law, you agree to reimburse Silxine for reasonable losses and costs caused by your unlawful misuse of the site, your violation of these Terms, or your violation of another person’s rights. This section does not apply to ordinary consumer use of a product.
17. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a legal claim, you and Silxine agree to try in good faith to resolve the issue by contacting each other.
Any court proceeding that is not eligible for small claims court will be brought in the state or federal courts located in Orange County, California, unless applicable consumer law gives you the right to bring it elsewhere.
18. Changes to these Terms
We may update these Terms when our services, practices, or legal obligations change. The version posted when you place an order applies to that order. Continued use of the site after revised Terms take effect means you accept them, to the extent permitted by law.
19. General terms
If one part of these Terms is found unenforceable, the remaining parts stay in effect. A delay in enforcing a right is not a waiver of that right. These Terms, together with the policies linked here and any terms shown at checkout, form the agreement between you and Silxine about use of the site and your order.
